Westgate Resorts Class Action Lawsuit

Nevada court might finally deliver timeshare ripoff victims the justice they deserve.


It has been amazing that such a blatantly dishonest company as Westgate Resorts has been able to continue lying to customers and selling timeshare rip-off scams for as long as they have.

It actually appears that Westgate might finally get what they deserve. A class action lawsuit has been filed against Westgate Resorts that apparently has a very good shot of winning in a Nevada court.

Utah Stories has been inundated over the past three years since I wrote my initial story on Westgate: Hollywood Dreams and Timeshare Nightmares about how their salespeople were blatantly lying about the cost, fees and potential value of their timeshares for sale in Las Vegas and Miami. To get to know Westgate you must know Westgate’s owner.

Mr. David Siegal attends events with celebrities and business moguls such as Dolly Parton, Vanna White, David Hasselhoff and even Bill Gates. All of which  have had their photos taken with Mr. Siegal. Appearing as chum buddies, Mr Siegal attempts to builds his credibility like a parasite does with his host.  The Westgate offices are plastered with photos of people who we know and might trust with Mr. Siegal.


Business owners and celebrities don’t realize it might take years to wipe the slime off their hands after they touch or even pose with this guy. Mr. Siegal has the most dishonest sales force I’ve ever encountered. These people make used car sales people look like angels. They lie, cheat and steal from customers through “gotcha” contracts or contracts they don’t honor because they assume the victim will not go through the trouble of filing an out of state lawsuit. We have found this not only personally but through the hundreds of customer testimonials we have acquired. The flood of testimonials has made me believe this would be a perfect case for a class-action lawsuit.

    Hello i had my timeshare for 8 years I’m do tired of them treating me I am trying to get out of my contract I hVe them so much money and when you 1 day late they call you majority all day I hBave been a good customer and they treat us as if we old thousands at once how can I get in on the lawsuit against Westgate I purchased mines in Orlando I have to pay my maintenance and taxes plus my monthly payment and the tax and maintenance posed to went toward a hug water park for the kids which been over 5 years and it’s not done yet

  2. I need to get out of this Westgate crap! Any ideas? has anyone just stopped paying? what happens? can they put a lien on your home in Canada??

    • Hi,
      I am also Canadian, and I used to work for Westgate. I was fortunate enough to work for a floor which was honest, and our owners were happy, and bought more weeks all the time. I also have stayed in their properties a dozen times, and honestly, no other resort can compare.
      Having said that, I am in the middle of a class action lawsuit with them, for failing to pay it’s employees millions of dollars in commissions. My clients were super happy, and so was I, but in 2008, Mr. Seigel closed down the floors for a month; kept all our money (7000 employees), and then re-opened; never to pay us.
      Therefore, I must say that if you want out; there are a few things you can do. One, of course is…stop paying. They can only call or mail you. That’s it. No Canadian SS# is given, so no way to report it to Equifax.
      Secondly; keep it, use it, and just rent it out when not using it. The resorts are amazing; and in very high demand, so you will get alot of trading power. You will love it, really. If you can afford to keep it…do so. I work for their competitor now, and I truly do miss their resorts, rooms, jacuzzi suites, amenties and just all the free comforts you find in the rooms. I hate to admit it:(
      Third..you can sell or donate it. If you just bought it….you will not make money but maybe find someone to take over payments. You can also rent it out; to cover the maintenace fees. The rooms are very, very expensive on Expedia, Priceline, etc… so people love to rent from owners.
      Just google your options…. and there is a great site called http://www.vacationtimesharerentals.com
      which can rent or sell it for you; with pictures, paypal, etc…
      Good luck to you; sorry you are not happy. I hate Mr. Seigel for cheating me and all the others, but I honestly beleived in my product, used it and loved it, and I truly would have never worked there, had I known they would do that to us. My clients were locals, and I still talk to them, so I am not embarrassed; they love their rooms and especially the beach locations in Miami. They are not 5 star hotels, they are more like 3 or 4 stars for amenities, but the rooms are full aparments with kitchens and jacuzzis; unlike any other places down here.
      Again, as a fellow Canadian, if you think you may be able to afford keeping it….do so because it’s one of the best resorts out there. Places in Canada, like Collingwood or BC, don’t trade well, and they use RCI, which has alot of dumps. Interval International has the brand name resorts, like Starwood and Marriot, so it’s really nice to have. Good luck to you:)

  3. I purchased a timeshare while in Vegas a few months ago. I had no intention on buying the timeshare and just wanted to get discounted tickets to a show. The sales person seemed very genuine and kind. The sales people there made me feel like I was getting a good deal because I was buying a foreclosure and I could exchange my one week every other year for two weeks. That is not true and after reading complaints about their company I don’t believe ANYTHING I was told during the presentation. I was suckered into buying a timeshare after being fed multiple lies about what I was buying. I did not find out until it was too late that what I was sold is completely different then what I was told. I am disgusted at this companies practices. They lie to honest and trusting people. They need to be held accountable for their lies.

    • March, 24,213. We have been Ripped of by Westgate in Vegas, Oct. 2008, all the same time we did not know about about the Utah Stories.com ;Hollywood Dreams and Timeshare Nightmares;
      They lying to everyone and they do not care who they steal money from.They are dishonesty and using high pressure to make a sale. They told us we worn a round trip to Hawaii for 7days for 2 free. We never got the trip. Westgate will take the milk bottle from a baby mouth. Westgate is a deceptive and fraudulent Timeshare company. You can not trust them. The Utah stories give you the same spill they tell everyone. I have good news; A 2013 Class Action ;if you feel you were mistreated and ripped off please call, Attorney JTB Law group 201 260 0251. and tell him your stories. ASAP.

  4. I am with you all. Let us all unite against timeshare especially Westgate. They prey on people who wants to have a little fun with what little they have. Dishonest and greedy companies like that don’t have a place in the Cosmos. I am in for a class action lawsuit.

    • I went in 2005 to Orlando Florida, I with my two children walk in the mail, and we were approach by a person from a booth, and asked us if we need discount ticket to Disneyland. We asked what the catch to get it is, she told us you just need t attend a presentation; the person asked if I am married I told no. that was good case for them. I didn’t know very well English and I didn’t know about the timeshare that was another plus for them. I asked where is the presentation she told if you give me your address we will send a car to pick you up. Next day from Westgate they come took us to their resort. The presentation was too long, and I told them we have to see it today, then they took us to office offer us different option. I told them I am a single parent I cannot afford that, they won’t let us go we lost half a day, and my children want see Disney. Finally he offer us that you can have two bedroom every other year, we will finance it for you, and you only pay $420 other year and you have 52 week in year to choose. The sales person seemed very genuine and kind. The sales people there made me feel like I was getting a good deal. Try to help me to get good deal. He told If don’t like the buy it back or rent it for you, the rent is very high. I didn’t had time to read the contract, and we were in hurry to have time to Disney, He just explain it to me and ask me initial here, sing there. Next I went back I could find the same person, asked if I can terminate the contract, because I don’t know anything about this. I am new In US the person told me no, you cannot since you sing it. When we back in Michigan, I asked my neighbor, he told it is scam, and they lied to you. I called to cancel it they oh it pass 11 day since you sign the contract you cannot. Then I found out that the interest is %24. I had to borrow money from my home equity to pay off there loan. Now every the maintenance go up. If you don’t pay it in January the charge you late fee pulse interest. The sales people need to be held accountable for their lies. Now the ask me to pay more than $900. Pulse I have to pay exchange fee if I am lucky to book somewhere. We I called last year to book I couldn’t book where I want to book. The said it on base of availability, but when they sold to me they lied that I can book it anywhere the world, which now I know you have pay other fee to international interval . That is another story, and fees.

    My husband and bought in recently and thus far everything they told us was a lie. the ciertificates we were given are almost worthless! We truly regret purchasing a time share with this company. They are indeed crooks and I feel sorry for the employees who work for this organization ,who must know that they are leading people astray with their lies. All we wanted was an affordable way to take vacations. We did not want to told one thing only to find out later that none of it was true. When I think of the lavish lifestyle the owner lives off of money he aquired through lies and misrepresentations, it makes me sick inside.

    MY AND MY WIFE AND KIDS WENT TO FL FOR SPRING BREAK. WE GOT ROPED INTO THIS FOR FREE TICKETS AND EXTRAS WELL IT SOUNDED GOOD. SO WE WENT FOR THE 90 MIN TOUR. WELL IT TOOK ALMOST 4 HRS TO GET OUT. WE LIKED WHAT WE HEARD BUT WAS NOT GOING TO MAKE THAT DECISION THAT DAY THEN THE PRESSURE CAME. WE STILL SAID NO SO THEN THEY OFFERD US A GETAWAY PKG (RIGHT GET A WAY HAHAHA JOKE ) WE WERE TOLD THIS PKG WAS A 1 WEEK STAY IN FL. AND WE HAD 3 GETAWAYS BUT THEY THROW IN A 4TH GET A WAY. NOW LET ME BREAK THIS DOWN FOR YOU THE COST WAS OVER $1000 BUT THAT WAS TO PAY FOR OUR WEEK AND OUR GETAWAYS. HAHAHAHA JOKES ON ME THE GETAWAYS WERE EXPLAINED TO US AS A GETAWAY! 2 TO 4 DAYS. ANYWHERE THEY HAVE RESORTS NOW THIS IS THE CRAZY PART. I TRIED TO BOOK IN LAS VEGAS FOR A GETAWAY AND WAS TOLD IT HAD TO BE FOR 7 DAYS (CANT UNDERSTAND HOW A GETAWAY IS 7 DAYS?) I EXPLANED TO THE LADY WHAT WE WERE TOLD AND SHE SAID IT WOULD COST ME $1100 TO STAY THERE AND I HAD TO STAY FOR 7 DAYS. SO I DECLIND. SO ME AND MY WIFE SAID LETS TRY SOME OTHER PLACE AND WE TRIED TO BOOK IN MIAMI AND WAS TOLD THE SAME THING. SO NOW WE CANT USE OUR GETAWAYS BECAUSE IN MY WORLD 7 DAYS IS A VACATION SO WE THEN CALLED THE CUSTOMER SVC NUMBER TO SEE WHERE WE COULD USE OUR GETAWAYS AND FOUND THERE IS NO SUCH THING AVAILABLE. MOST PLACES HAVE A MIN NIGHT STAY 6NIGHTS AND 7 DAYS. SO WE HAVE TRIED CALLING AND CALLING TO GET THIS CORRECTED BECAUSE WE WERE TOLD WE COULD.
    SO WE HAVE NOW STOP PAYING THEM AND NOW THEY HAVE SENT US TO A CREDIT COLLECTION AGENCY AND WE TRIED TO EXPLAIN TO THEM AS WELL BUT IT SEEMS LIKE NO ONE CARES AND THEY KEEP GETTING AWAY WITH THIS BS THEY CALL THE '' TEST DRIVE " TO SEE IF WE WANT TO BE OWNERS.       I did they same thing except I was in Vegas. Me and a friend was walking down the street taking in the sites and we were pulled off the steet by some lady offering us tickets to shows and such if we went in and listened to their 90 min speech. It was over four hours before we got out of there. they offered me a 10,800 dollar deal. everything they have promised was a lie. Now they are after me for the money. I never paid them anything while I was there, but i keep getting phone calls and letters in the mail saying i owe them. I don’t plan on paying them either beause everything they have promised was a lie. I called and have talked to them numorous times, I either get we are sorry mam but you are stuck in the contract and have to pay or they hang up on me. it is a good scam. I fell for it and now i feel very stupid. I would to rather have a bad blish on my credit then to pay them anything.

  8. Hi, what should I do? I paid over 6000.00 to Westgate as monthly payment and tax and maintenance with no chance to use my unit even once due to lack of availability. I call Westgate to resolve this issue but they said they cannot take it back and I’m responsible for the unit till get sold and I know no one can take this scam no more.
    Please help me what to do? My children deserve this money more than the wealthier try be richer.

    • I can understand you last night I was for 5 hours on the phone. Since I have foreigner accent the were so rude to me. The asked me to late fee and interest pulse the maintenance fee. If I don’t use why I should pay maintenance fee. Siegel ( owner of Watergate) is billionaire because of you and me. Please let me know also what to do. We should bring a class action agiant westgate.

Weestgate resort lied to us and prevented us from cancelling the very next day of our purchase in Orlando,FL!They took advantage of us cause we were foreigners and did not know much about Timeshares!They told us we had 30 days to cancel,they pressured us to buy cause it was so cheap and always talked about buying a villa,not a timeshare ,a villa!We fell for it but the realized our mistake and called the next day but were denied!
    They told us to call the agent who at the office impersonated an agent of Florida,told us she would help us to cancel it but then a day after she disappeared,we kept calling her and calling her but her voicemail box was full.Then the 10 days cancellation passed and we were trapped so we started paying a little until police advized us to stop the payments and call our credit compagnies to notify them!They are scums who scammed us!I want to be part of this class action,I made a video on YT warning potential victims about them!!!

    My family and I made our first trip, since our purchase, to Park City during the week following Labor Day. Upon checking into our unit, I quickly realized that we were in the wrong unit. In fact, the room that we were checking in to, as described on our website, was a Studio Standard Villa?

    Thus, I knew that this was not the correct room because our realtor had indicated the unit to be a one-bedroom standard villa, the paperwork confirms a 1/1 and a Westgate contact (Rusty) also confirmed this fact. Furthermore, when I view the Official Westgate website and also the dedicated sight for the Park City location. Both sites describe the one-bedroom unit, which displays among other facts, a square footage of approximately 750 feet. So you can sense my frustration when being placed in a unit that is half the size of the unit, which I supposedly purchased? Moreover, I contacted the front desk to address this concern, but was then advised that I am in the correct room and that I should take my grievance up with ownership services in the morning.

    After speaking with our VIP Concierge the next morning, he determined that it was best to meet the following day which resulted another night in the cramped studio unit. Nevertheless, Hong and I met with Ownership Services the following morning to resolve and to try to get greater clarify from Westgate. Unfortunately, not only was the staff at Westgate Ownership Services unable to resolve my concern, but they decided early on in the conversation that my concern was invalid and immediately sought out this opportunity to up-sell. From their perspective, both of the Westgate websites describing the one-bedroom are invalid. They claim that the studio and a one-bedroom standard are one in the same, even though the website(s) clearly shows a vast distinction between these units. After no cooperation from this team and a continuous spin on the issue at hand, I determined that I need to enjoy my vacation and contacted reservations directly and was able to upgrade (for a fee) into my expected unit at the initial check-in

    Ultimately, I decided to purchase this unit earlier in the year based on the details on the initial MLS listing, insight which the realtor had provided from the county and previous owner, Westgate’s feedback concerning this 1/1 villa and the specific description of the “one-bedroom standard” villa highlighted on their external websites (i.e. – http://westgateresorts.com/park-city/accommodations/ ).

    Conversely, a studio does not satisfy my current situation and I would have never contemplated purchasing such a unit. In Westgate fashion, they are now unresponsive to all of my follow up inquiries since the trip. Moreover, each time I speak to someone else within Westgate or someone outside (either specializing in real estate and/or timeshares), I am further reassured that this is a highly unethical company, which continues to spam its owners and perspective buyers.

  11. they lied us to .we bought 2 years ago ,we use once and since then try to sell its worth maybe few hundreds ,we lived in canada .they didn’t tell us true ,there is lots rules we didn’t know ,they fraud us

Westgate has lied to us twice the first time when the sld us a 1 bed room they promissed us the world that we would get weekends when we wanted them an we didn’t we need to pay full price for them and now tht we got a 2 bed room the stated and on the sheet that we did the negotieations on that the maintanace fee would be $674. And now tht its due its $873.00 when I called to complain they said look at ur hud document it states it an estimated quote but when they made us signed all that paper work they didn’t stop us and say pay attention it states its an estamated price only. Very disapointed with west vate and now to hear they r going bk. I want to sell my time share want nothing to do with westgate their customer service is horriable and their management staff is th same.

    I also purshased a timeshare from Westgate Resorts approx. 8 or 9 years ago. The price I paid was way mmore then they told me the timeshare was worth and the maintence fees are about 700% higher then they told me they would be. I even tryed to sell them the timeshare back for 800% less then what I paid and they didn’t want it. I live in Florida and my timeshare is in Orlando. Anyone that can give me some advise I would appreciate it. I have called then to complain but they could care less. How do the rest of the westgate owners get into this class action suit? Mine in aid off but I’m still paying a maintance fee of over $800.00 a year. For that kind of money I could rent a much nicer place then westgate.

    • We have to c/o to every department in the US. U.S Department of Justice and the Attorney General Office in FL. Consumer Department there a list of Governments you can c/o We need a good Attorney one that is not for sale. like Aldo B. in Fl. he sold us out.

    We were just offered a settlement. I am owed almost 28K from them and they are trying to settle for 3%. I plan on filing against them in civil court and ask for damages. Any salesperson that wants a good attorney message me and I will give you the info. Leon Greenberg and associates worked on this and could not get a judge to rule on OT and wages. I am suing straight out and have a better chance of winning what I am owed as opposed to going in on another class action.

  15. I am going to be one of the members to get a lawyer and sue the timeshare company.

    I HATE THEM THEY ARE THE BIGEST EVILS OF AMERICA.

    I can pay a lawyer to fight the case and everybody should get their money back..
    All of us should unite and look for the TOP MOST LAWYER who can handle and screw them properly and tightly so all of us can get our money back..
    They are all FU***D up assh***s.

      Everyone must write a letter to the Attorney General office in Fl. Pam ,
      Attorney General Office in DC. and NV.
      Also c/o to U.S. Department of Justice Consumer Protection Branch Civil Division Washington, DC. 20530. When they get enough complaints the justice depart will start to investigate our stories. And who knows those crooks will be put in jail.

  17. I agree, we wre told buying a red week would ensure we had priority exchange through interval international. Every time we look to exchange there are no matches. For us it was all about the exchange as we reside in Australia. Our first family holiday overseas was ruined by these crooks. If there is an avenue to get my money back. Count me in!

      They need to be put under the jails. They told us lies and that it would pay for it self. We have been trying to cancel this timeshare and get our monies back from Westgate Planet Hollywood, NV,
      We never saw the timeshare nor spent one night in it. every time we called it were all ways a story behind it.We are in need of a real class action lawyer. And no someone tell you lies and keep telling you lies too.

  19. we having been fighting with Westgate for years. They sale you thi big story about how you can book at your resort anytime. What a bunch of bull! You can hardly ever get into your week unless you book in winter months! At the same time they are having nontimeshare holders in there in the summer. yea could of booked a nice week someplace else for what the taxes are.

  20. Westgate Corporation & the people who represent it are a bunch of crooks. They tell you one thing and then say another. I regret buying this time share & I am looking into all legal aspects into suing them.
